HOW TO APPLY LOCATIONAL CLEARANCE

ISSUANCE OF LOCATIONAL CLEARANCE

Who may avail of the services:

  • Any person or entity who proposes to construct Residential, Commercial, Institutional Building and other structures regardless of size and cost.
  • Any person or entity who would like to acquire Zoning Certificate to support application with other agencies such as ECC, Foreshore Lease, etc.
  • Any person or entity who proposes to introduce an activity to a piece of land for legal purposes.

What are the requirements:

  • For  Locational Cleareance
    • A. Basic Requirements (two copies per documents)
      1. Duly accomplished and notarized APPLICATION FORM
      2. Any of the following requirements relative to RIGHT OVER THE LAND
        • a. photocopy of certificate of title in case registered in the name of applicant
        • b. in absence of any existing certificate of title in the name of the applicant, submit b.1. certified true copy of the latest tax declaration an
          • b.2. pro-forma affidavit (see attached form) to the effect that:
            •  the applicant is the owner of the property subject of the application;
            • that the property is situated within alienable and disposable lands and outside lands reserve for the public domain;
            • that the property is free from liens and encumbrances of the property, or stating the liens and encumbrances of the property;
            •  that the property is not tenanted (in case the property is planted to rice and corn)
        • In case the property is not registered in the name of the applicant, submit duly notarized deed of sale or deed of donation; or contract of lease or authorization to use land, whichever is applicable plus the photocopy of the owner's certificate of title in the absence of title, the tax declaration and pro-forma affidavit as described in the title b hereof.
      3. VICINITY MAP showing the existing land uses within the prescribed radius from the lot boundary of the project site:
        1. for projects of local significance, the vicinity should cover a minimum of 100 meters radius and the map need not be drawn to scale provided the relative distances of existing land uses to the project site lot boundaries are indicated;
        2. for projects of national significance, the vicinity should cover a minimum one (1) kilometer radius and should be drawn to scale.
      4. SITE DEVELOPMENT PLAN showing the project site lot area boundaries and dimensions of proposed improvements within the project site; the plan need not be drawn to scale for projects of local significance.
      5. FILING FEES
      6.  Zoning Certification 
      7. Environmental Compliance Certificate (ECC) or Certificate of Non-Coverage (CNC) if applicable.
    •   B. Additional Requirements (two copies per document)
      1. For applications filed by Authorized representatives; SWORN SPECIAL POWER OF ATTORNEY for representative to file/follow-up application and claim decision to the application.
      2. Barangay Construction Clearance 

 

  • For  Zoning Certificate
    1. Duly accomplished APPLICATION FORM
    2. Photocopy of certificate of title in case registered in the name of applicant.
    3. Certified copy of latest tax declaration.
      • In case the property is not registered in the name of the applicant, submit duly notarized deed of sale or deed of donation; or contract of lease or authorization to use land, whichever is applicable plus the photocopy of the owner's certificate of title in the absence of title, the tax declaration.

Pays appropriate fee to the city treasurer and submit Official Receipt to Zoning Section and complies the lacking document/s, if any.
